O R D E R

The petitioners seek direction for early disposal of the suit in O.S.No.93 of 2020 pending on the file of District Munsif Court, Pollachi.

2. Considering the limited prayer sought for, notice to the respondents is deemed unnecessary.

3. The suit was filed by the plaintiff / 1st respondent seeking permanent injunction restraining the defendants from interfering with his possession of the suit property. It is seen that the defendants 1 to 7 have filed written statements and the 8th defendant, who is father-in-law of the plaintiff is yet to file the written statement. It is reported that the 1st defendant is dead and the suit was adjourned for taking steps to bring on record the legal representatives of the deceased 1st defendant. It is seen from the plaint itself that the defendants 2 to 4 are the legal representatives of the deceased 1st defendant. The trial Court could have done well to record them as the legal representatives of the deceased 1st defendant, instead of adjourning it for steps.

4. In view of the above, there will be a direction to the trial Court to dispose of the suit within a period of one (1) year from the date of receipt of a web copy or a certified copy of this order. No costs. 30.11.2021 dsa Internet : Yes Index : No Speaking order To The District Munsif, Pollachi.
