The Criminal Original Petition has been filed by the petitioner to file a final report in Crime No.08/2018/AC/VPM on the file of the Inspector of Police Vigilance and AntiCorruption, Villupuram within a time frame. 2.The learned counsel for the petitioner would submit that the petitioner is the District Secretary of Minority Division, Communist Party of India, who had given a complaint to the Respondent on 08.06.2018, against the former President, Vice President and Secretary of Pootai Village Panchayat, Sankarapuram, Villupuram District. Based on the complaint given by the petitioner, a preliminary enquiry was conducted. 3.According to the petitioner, the accused have jointly misappropriated the funds to the tune of Rs.30,00,000/- during the year 2013-2014 and 2014-2015. F.I.R. came to be registered in Crime No.08/2018/AC/VPM for the offence under Section 167, 468, 471, 477(a), 420, 409 IPC and Sections 13(2), 13(1)(c) of the Prevention of Corruption Act, 1988 and 37 of IPC https://hcservices.ecourts.gov.in/hcservices/
4.The grievance of the petitioner is that despite the registration of the case, no worthwhile investigation has been carried out. Hence, the petitioner has filed this Criminal Original Petition, seeking direction of this Court to file a complete investigation report and to file a charge sheet. 5.The learned Additional State Public Prosecutor would submit that investigation has already been completed and the charge sheet is also made ready. In this case, one M.Kandasamy, Formerly Panchayat President and G.Arunachalam, Formerly Panchayat Vice President of Pootai Village Panchayat, Sankarapuram have been arraigned as accused.
She would further submit that the draft charge sheet already approved by the Deputy Legal Advisor and charge sheet for offence under Section 120(b), 167, 468, 471, 477(A), 409 IPC, 13(2) r/w 13(1)(d) of Prevention of Corruption Act, 1988 to be filed soon on or before 25.09.2019. Accordingly, prays for appropriate orders. 6.In view of the above submissions made by the learned Additional State Public Prosecutor, this Court directs the respondent to file a charge sheet on or before 25.09.2019. 7.With the above direction, this Criminal Original Petition stands disposed of.
