Respondents Prayer: Writ Petition filed to filed under Article 226 of the Constitution of India, seeking to issue a Writ of Mandamus, directing the 1st respondent to dispose the appeal dated 3.1.2012 filed by the petitioner within stipulated period that may be fixed by this Hon'ble court.

ORDER

Heard the learned counsels appearing on behalf of the parties concerned.

2. At this stage of the hearing of the Writ Petition, the learned counsel appearing on behalf of the petitioner had submitted that it would suffice, if a direction is issued to the first respondent to dispose of the appeal, dated 3.1.2012, on merits and in accordance with law, within a time frame specified by this Court.

3. The learned counsel appearing on behalf of respondents 1 and 2 has no objection for such an order being passed by this Court. https://hcservices.ecourts.gov.in/hcservices/

4. In view of the submissions made by the learned counsels appearing on behalf of the parties concerned, the first respondent is directed to dispose of the appeal filed by the petitioner, dated 3.1.2012, within a period of eight weeks from the date of receipt of a copy of this order, if the appeal is in order, after giving an opportunity of hearing to the petitioner, as well as the other persons concerned, if any. However, it is made clear that this Court, by this order, has not expressed any opinion on the merits of the matter.

5. Accordingly, the Writ Petition is disposed of, with the above directions. No costs.
