(R2 to R4 were impleaded as per order of the court dated 02.2.2018 by MKKSJ vide MP.No.1 of 2014)...Respondents in WP.No.28875/13 PETITION under Article 226 of The Constitution of India praying for the issuance of a Writ of Mandamus directing the respondent herein to process the petitioner's passport application in file No.CB1061486818412 dated 19.7.2012 on the file of the respondent herein and to issue passport to him within the time frame as may be fixed by this Court. ORDER

Heard both and perused the records.

2. The writ petition has been filed seeking a direction to the first respondent herein to process the petitioner's passport application in file No.CB1061486818412 dated 19.7.2012 and issue passport to him.

The case of the petitioner is that he has been falsely implicated in Cr.Nos.102 and 134 of 2011 on the file of the Central Crime Branch, Coimbatore and Cr.Nos.18 and 27 of 2011 on the file of the Central Crime Branch, Tirupur. According to the petitioner, he has not furnished the details about the said criminal cases while applying for passport. Since his application for issuance of passport was not processed, the petitioner sent representations dated 18.12.2012 and 01.8.2013 to the first respondent to issue passport. Since the said representations also have not yet been considered, the petitioner approached this Court.

4. The learned Senior Panel Counsel for the first respondent submits that the present status of the criminal cases was not furnished by the petitioner and after getting necessary instructions from the concerned police, the first respondent would process the application.

5. In the light of the said submission, the writ petition is disposed of with a direction to the first respondent to process the application of the petitioner on merits and in accordance with law, after getting necessary particulars from the concerned police. No costs.
