P. DHANABAL.J., The petitioner apprehends arrest for the alleged offences under Sections 147, 364, 302 read with 149, 506(ii) and 201 of IPC in S.C. No.700305 of 2015 before the II Additional Sessions Judge, Salem Disrict, seeks anticipatory bail.

2. When the matter is taken up for hearing today, the learned counsel appearing for the petitioner would submit that the petitioner is arrayed as A2 in this case and due to his non-appearance, the trial Court has issued non-bailable warrant and the same is pending before the Trial Court and the petitioner is ready to surrender and hence he seeks anticipatory bail to the petitioner.

3. This Court also called for report from the Trial Court and the trial Court submitted the report. As per the report, NBW is pending against A1, A2 and A7 and thereafter as against A7, NBW was executed and NBW is pending against this petitioner and A1.

4. Since the NBW is pending against this petitioner, it is appropriate

to direct the petitioner to appear before the trial Court by filing petition to recall the non-bailable warrant and if any such application is filed, the trial Court is directed to consider the said application on the same day on merits in accordance with law.

5. With the above directions, this criminal original petition is disposed of.
