The petitioner, who was arrested and remanded to judicial custody on 06.01.2022 for the offences punishable under Sections 392, 397 and 506(ii) of IPC in Crime No.1 of 2022 on the file of the respondent police, seeks bail.

2. The case of the prosecution is that the petitioner waylaid the defacto complainant and snatched a sum of Rs.950/- from him at knife point. Hence the complaint.

3. The learned counsel for the petitioner submitted that the petitioner is an innocent person and no way connected with the alleged offence and he has been falsely implicated in this case. Hence, he seeks for grant of bail to the petitioner.

4. The learned Government Advocate (Crl.Side) appearing for the respondent submitted that the petitioner is an history sheeter and habitual offender having 9 previous cases pending against him. If he is released on bail, he will indulge in similar crime. Hence, he vehemently opposed for grant bail

to the petitioner.

5. Considering the bad antecedents of the petitioner and now there is no change in circumstances of this case and also charge sheet has been laid. Therefore, this Court is not inclined to grant bail to the petitioner.

6. Accordingly, this Criminal Original Petition is dismissed. The concerned Trial Court is directed to take cognizance on basis of the final report filed by the respondent within a period of two weeks from the date of receipt of a copy of this order.
