This petition has been filed to modify the condition imposed in Crl.O.P.No.18840 of 2022 dated 10.08.2022 that No.(a) that the petitioner shall deposit a sum of Rs.1,18,000/- (Rupees one lakh eighteen thousand only) to the credit of defacto complainant bank as Concern Group Account within a period of two weeks.

2. The learned counsel for the petitioner would submit that the petitioner deposited the said amount to the defacto complainant's bank as Concerned Group Account. However, the learned Magistrate returned the surrender application on the ground that the petitioner failed to deposit the said amount to the account of the defacto complainant's bank. But the petitioner paid the amount to the defacto complainant's bank as Concerned Group Account.

3. In view of the above submission, the petitioner had complied with the condition to deposit a sum of Rs.1,18,000/-. Therefore, the learned Magistrate is directed to accept the sureties and proceed in accordance with law.

4. With the above direction, this Criminal Miscellaneous Petition is disposed of.
