O R D E R

This Writ Petition has been filed for a direction to the respondents 1 to 3 to take appropriate actions as prescribed under the law on the illegal and unauthorized construction, which is being put up at the Western Side of property 4 and 5th respondent house Arokiyapuram, Wellington, Barracks Post, Nilagiri District based on the petitioner's complaint dated 19.07.2024 and 30.07.2024.
2. It is the case of the petitioner that the respondents 4 and 5 are the owners of the property situated on the western side of the property of the petitioner. There was an unlawful construction made by the respondents 4 & 5, which fell down on the compound wall of the petitioner on 18.07.2024. Though the son of the petitioner made a complaint dated 19.07.2024 to the respondents 1 and 2, followed by a representation dated 30.07.2024 by the petitioner to the 3rd respondent about the illegal 2/4
construction put up by the respondents 4 and 5, no action has been taken against them. Hence, the petitioner is before this Court.
3. Learned Special Government Pleader appearing for the respondents 1 to 3 stated that a reasonable time may be granted to the respondents 1 to 3 for considering and taking action on the complaint and representation dated 19.07.2024 and 30.07.2024 respectively made by the petitioner.
4. Considering the facts and circumstances of the case and taking note of the limited scope of the relief sought for by the petitioner, this Court, without expressing any opinion on the merits of the matter, directs the respondents 1 to 3 to consider the online complaint dated 19.07.2024 as also the representation dated 30.07.2024 of the petitioner, by giving an opportunity of personal hearing to the petitioner, R4, R5 and other parties concerned and thereafter, take suitable action in accordance with law. Such an exercise shall be carried out within a period of twelve weeks from the date of receipt of a copy of this order. 3/4
