Writ Petition filed under Article 226 of the Constitution of India praying to issue a Writ of Mandamus, directing the 2nd respondent to pass orders on the petitioners objection dated 14.02.2025 and revise the enhanced tax of Rs. Rs.2845/- in respect of the petitioners property in D.No.171-A6B, Ward- 11, Indira Nagar, Mettur Dam- 1, Salem District by following the procedure laid down under the Tamil Nadu Urban Local Bodies Act, 1998 1/6

ORDER

This writ petition has been filed to direct the 2nd respondent to pass orders on petitioner's objection dated 14.02.2025.

2. Mr.M.S.Premkumar, learned Government Advocate, takes notice on behalf of the 1st respondent and Mr.L.P.Maurya, learned counsel takes notice on behalf of the 2nd respondent. By consent of the parties, the main writ petition is taken up for disposal at the admission stage itself.

3. The learned counsel for the petitioner would submit that in this case, the petitioner, being the owner of the subject properties, is regularly paying the property tax for the subject property to the respondents. Under these circumstances, the property tax for the subject property was enhanced by the respondents vide notice dated 12.02.2025, whereby, they 2/6

demanded Rs.2,845/- as property tax.

4. Further, he would contend that aggrieved over the said notice, an objection was filed by the petitioner on 14.02.2025. However, the said representation was not at all considered by the respondent till date. Hence, this writ petition.

5. In reply, the learned Government Advocate appearing for the respondents would requests this Court to pass appropriate orders directing the respondents to consider and dispose of the objection filed by the petitioner.

6. Heard the learned counsel for the petitioner and the learned Government Advocate for the respondents and also perused the materials available on record.

7. In the case on hand, the property tax for the subject property was enhanced by the respondents vide notice dated 12.02.2025, whereby, they 3/6

demanded Rs.2,845/- as property tax. Against the said notice, the objection was filed by the petitioner on 14.02.2025. However, the said objection was not considered by the respondents till date.

8. In view of the above, this Court directs the respondents to consider the petitioner's objection dated 14.02.2025 and dispose of the same on its own merits and in accordance with law within a period of 6 weeks from the date of receipt of copy of this order. Further, the respondents are directed to defer the recovery proceedings against the petitioner till the disposal of aforesaid objection filed by the petitioner.

9. With the above directions, this writ petition is disposed of. No costs.
