This application has been filed by the applicant/plaintiff to implead the proposed 4th defendant herein as necessary party to the above Civil Suit.

2.The learned counsel for the applicant would submit that the first respondent is under liquidation and the 4th respondent has been appointed as Interim Resolution Professional and hence, he is a necessary party.

3.Learned counsel for the second respondent would submit that once the first respondent is liquidated, the Interim Resolution Professional will represent the company and hence, there is no necessity to implead the 4th respondent as 4th defendant in the suit.

4.However, considering the facts and circumstances, this application is allowed.
