Dhanabakkiyam (Died) v. Arumuga Gounder (Died)

CMP.Nos.21021, 21023 & 21024 of 2021 in SA.No.1338 of 2004 Krishnan Ramasamy, J., These petitions have been filed to condone the delay in filing the application, to set aside the abatement caused due to the death of 1st respondent namely Arumugha Gounder and to bring on record the proposed respondents 4 to 9 as legal representatives of the deceased 1st respondent.

2. Being satisfied with the reasons stated in the accompanying affidavits filed in support of the miscellaneous petitions and as the learned counsel for the respondent has no objection in allowing the same, CMP.No.21021 of 2021 to condone the delay of 546 days, stands allowed and the delay is condoned; CMP.No.21023 of 2021 to set aside the abatement caused due to the death of 1st respondent, stands allowed and the abatement is set aside; CMP.No.21024 of 2021 to bring on record the proposed respondents 4 to 9 as legal representatives of the deceased 1st respondent, stands allowed.

3. Registry is directed to make necessary amendments in the cause title within a period of 10 days from today and thereafter, list the matter on 22.09.2022.
