ORDER : The Court Made the following order :- (The case has been heard through video conference) The petitioner who was arrested and remanded to judicial custody on 26.12.2020 for the offences under Sections 460, 395, 397 IPC in Crime No.2794 of 2020, on the file of the respondent police, seeks bail.

2. The case of the prosecution is that on 19.12.2020 at about 1 a.m., some persons broke open the door of the defacto complainant's house and attacked the defacto complainant and his wife with iron rod and robbed gold jewels and cash worth about Rs.1,40,000/-. Hence, the complaint.

3.The learned counsel for the petitioner would submit that the petitioner has not committed any offence as alleged by the prosecution and he has been falsely implicated in this case. He would further submit that the petitioner has been suffering incarceration for about one year from 26.12.2020 and hence, he would pray for grant of bail to the petitioner.

4.The learned Government Advocate (Crl. Side) would raise strong objection stating that the petitioner is arrayed as A1 and that the stolen properties have not been recovered but admits that the investigation has been completed and the charge sheet has been filed and the same has been taken on file.

5.On seeing the modes operandi, if he released on bail he would tamper the evidence this Court is not inclined to grant bail to the petitioner.
