Prayer : Writ Petition filed under Article 226 of the Constitution of India for issuance of a Writ of Mandamus, to direct the respondents 1 to 3, to award the incentive increments to the petitioner for M. Phil (Tamil) with effect from 20.09.2017 with all monetary benefits on the basis of her application dated 19.08.2019 within a stipulated time.

This writ petition has been filed for issue of writ of mandamus directing the respondents 1 to 3, to award the incentive increments to the petitioner with effect from 20.09.2017 with all monetary benefits by considering the application submitted by the petitioner on 19.08.2019 in this regard. 2.Heard Mr.N.Naganathan, learned counsel appearing on behalf of the petitioner and Mr.K.M.Ravikumar, learned Government Advocate appearing on behalf of the respondents.

3.The case of the petitioner is that she has completed a higher qualification during the course of her employment prior to 10.03.2020. Therefore, the petitioner claims for incentive increments as per the relevant Government order. The grievance of the petitioner is that in spite of representations made by her, the incentive increment has not been granted to the petitioner by relying upon G.O.Ms.No.95, dated 26.10.2023. In view of the same, the present writ petition has been filed before this Court seeking for appropriate directions.

4.Taking into consideration the facts and circumstances of the case and also the limited relief that has been sought for in this writ petition, there shall be a direction to the 2nd respondent to deal with the application submitted by the petitioner on 19.08.2019 on its own merits and in accordance with law and in line with the earlier orders passed by this Court and take a decision, within a period of six weeks from the date of receipt of copy of this order. 3/6

5.The petitioner is directed to make a fresh representation to the 2nd respondent along with the application dated 19.08.2019 and all the other relevant documents and also a copy of this order. 6.This writ petition is disposed of with the above directions.
