The petitioner who apprehends arrest at the hands of the respondent police for the offences punishable under Sections 454 & 380 of IPC in Crime No.303 of 2022, seeks anticipatory bail.

2. The case of the prosecution is that the petitioner along with the other accused had broken up the Auto Finance Office and committed theft of cash of Rs.2,00,000/- along with RC Book of "Honda Shine Bike".

3. The learned counsel for the petitioner would submit that the petitioner is an innocent person and due to financial dispute, the defacto complainant had foisted a false case against the petitioner. Therefore, he prays for grant of anticipatory bail to the petitioner.

4. Per contra, the learned Government Advocate (Crl.Side) appearing for the respondent would submit that the petitioner is a habitual offender and there is one previous case pending against the https://www.mhc.tn.gov.in/judis

shk petitioner as similar in nature. A2 in this case has been arrested and from him Rs.10,000/- has been recovered and the investigation is in progress. Therefore, he vehemently opposed to grant anticipatory bail to the petitioner.

5. Taking into consideration the facts of the case and the submissions made by the learned counsel, and also taking note of the fact that there is one previous case is pending against the petitioner as similar in nature, this Court is not inclined to grant anticipatory bail to the petitioner.
