Respondents (Respondent No.5 suo-motu impleaded as per the order dt. 30.10.2012) Petition filed under Article 226 of the Constitution of India praying for issue of Writ of Mandamus directing the C.B.C.I.D. to investigate the illegal quarrying of sand in the rivers of Tamilnadu and to submit a report before this Court and also direct the first respondent to pay a sum of Rs.5,00,000/- (Rupees Five Lakhs only) to the families of the persons who died in the river drowning due to illegal quarrying in the State of Tamilnadu.

2. The report of the District Collector, Tirunelveli dated 13.12.2013 has been perused. It is stated that criminal cases were filed. In so far as the compensation is concerned, it is stated that in two cases, compensation has been granted. But in the remaining cases neither the deceased has been identified by anybody nor any claim for compensation has been received from any family members. It is further alleged that deaths occurred due to fault of the deceased for lack of swimming capability. Steps are stated to have been taken to prevent the illegal mining in the river bed and at present, no sand quarrying is going on in the river bed in Tirunelveli District.
