The petitioner who apprehends arrest at the hands of the respondent police for the alleged offence under Sections 8(c) 20(b)(ii)(B) of the NDPS Act, 1985 in Cr.No.296 of 2021 on the file of the respondent police, seeks anticipatory bail. 2.The case of the prosecution is that the petitioner is alleged to have been found in possession of 2 Kgs. of Ganja. 3.The learned counsel appearing for the petitioner submitted that the petitioner has not committed any offence as alleged by the prosecution.

4.The learned Government Advocate (Crl. Side) appearing for the respondent submitted that earlier, the petitioner approached this Court by filing Crl.O.P.Nos.9782 and 15015 of 2021 and this Court dismissed the petition in Crl.O.P.No.15015 of 2021 and Crl.O.P.No.9782 of 2021 was dismissed as withdrawn. 1/2 https://www.mhc.tn.gov.in/judis

pri 5.Considering the fact that the quantity of the contraband seized is a commercial quantity and since there is no change in circumstances subsequent to the order passed in Crl.O.P.No.15015 of 2021, this Court is not inclined to grant anticipatory bail to the petitioner.
