PRAYER: Criminal Original Petition filed under Section 482 of the Code of Criminal Procedure, to direct the respondent police to provide adequate police protection to construct bathroom and toilet for the petitioner and his family members in the land in Survey No.49/2 which belongs to the petitioner. ORDER

This petition has been filed to direct the respondent police to provide adequate police protection to construct bathroom and toilet for the petitioner and his family members in the land in Survey No.49/2 which belongs to the petitioner.

2. The grievance of the petitioner is that earlier the petitioner's father lodged a complaint before the respondent police against the Respondents 2 to 5, in which enquiry was conducted and the respondents 2 to 5 appeared before the first respondent and agreed not to cause any hindrance in the construction put up by the petitioner, but contrary to the same, when the petitioner started construction, the respondents 2 to 5 started interfering and objecting to the same. petitioner approached the first respondent, the first respondent refused to take action against the respondents 2 to 5 and hence this petition.

The learned Additional Public Prosecutor submitted that the complaint said to have been lodged by the petitioner on 13.09.2021 has not been received by the respondent police and there is no complaint as on date against the respondents 2 to 5. He further submits that if the complaint 13.09.2021 is produced by the petitioner, the respondent police will act in accordance with law.

In view of the same, the petitioner is directed to appear before the first respondent along with the copy of the complaint dated 13.09.2021, along with supporting documents, within a period of two weeks from the date of receipt of a copy of this order and on receipt of the same the first respondent shall conduct enquiry and act in accordance with law.
