This Criminal Revision Case has been preferred against the order dated 09.01.2025 passed by the learned Chief Metropolitan Magistrate, Egmore, Chennai in Crl.MP.No.65662 of 2024, thereby dismissed the petition filed for direction under Section 173(4) of BNSS. 2.

Heard, the learned counsel appearing for the petitioner, the learned Government Advocate(crl.side) appearing for respondent 1 & 2 and perused, all the materials placed before this Court.

On perusal of the complaint lodged by the petitioner, it is revealed that there was civil dispute between the petitioner and the counter parties in respect of their plots. In fact, the petitioner's father filed probation OP to probate a Will and the same was also dismissed and confirmed by the Hon'ble Division Bench of this Court. That apart, the petitioner's father filed suit for bare injunction. While being so, on the strength of the order passed by this Court in WP.No.27763 of 2024 dated 26.09.2024, the service connection box has been transferred to the plot No.1. Therefore, there is no prima facie allegation made out to constitute any offence. Hence, the trial court rightly dismissed the complaint and this Court finds no infirmity or illegality in the

impugned order.
