Respondent(s) PRAYER This Criminal Original Petition is filed under Section 528 of BNSS, to direct the respondent 1 to 4 to take action against the 5th respondent and help to vacate them from the shop No.148 situated in Survey Nos.875,876,877 part with an extend of 249 1/2 at St Thomas Mount based on the complaint sent by the petitioner dated 02.06.2025.

ORDER

This Criminal Original Petition has been filed to direct the respondents 1 to 4 to take action against the 5th respondent and help to vacate them from the shop No.148 situated in Survey Nos.875,876,877 part with an extend of 249 1/2 at St Thomas Mount based on the petitioner's complaint dated 02.06.2025. 2/6

2. Heard the learned counsel for the petitioner and the learned Government Advocate (Crl.Side) appearing for the respondents-Police and perused the materials available on record.

3. Learned Government Advocate (Crl.Side) appearing for the respondents-Police submitted on receipt of the petitioner's representation dated 02.06.2025, notices dated 24.06.2025 & 02.07.2025 were served to the petitioner for enquiry. The petitioner did not appear and co-operate for enquiry. Hence, the respondents-Police could not proceed further.

4. In view of the above, this Court is not inclined to grant the relief as sought for by the petitioner in this petition. However, the petitioner is at liberty to give a representation afresh before the respondent-Police and on receipt of the same, the respondent-Police is directed to send fresh summon to the petitioner, fifth respondent, rival claimants and conduct enquiry and proceed further in accordance with law and pass orders in the manner known to law. 3/6

5. With the abovesaid direction, this Writ Criminal Original Petition is dismissed.
