Criminal Original Petition filed under Section 482 of the Code of Criminal Procedure, to modify the condition imposed by the learned Principal Sessions Judge, Thiruvallur in Crl.M.P.No.2327 of 2023 in Crl.A.No.118 of 2023 by the order dated 08.06.2023 directing the petitioner to deposit 10% of the compensation within 30 days before the trial Court to the credit of CC.No.90 of 2018 and that in default the order passed will stand canceled automatically.

ORDER

The Criminal Original Petition has been filed seeking for modification of one of the conditions imposed by the Court below while suspending the sentence by an order dated 08.06.2023 in Crl.M.P.No.2327 of 2023 in Crl.A.No.118 of 2023.

2. Heard the learned counsel for the petitioner and the respondent and also perused the materials available on record.

3. The Court below had imposed a condition by directing the petitioner to deposit 10% of the compensation amount within a period of 30 days. This condition is sought to be modified in this petition.

4. Taking into consideration of the facts and circumstances of the case, this Court is not inclined to modify the said condition. However, the petitioner is given two weeks time from the date of receipt of copy of this order to comply with the condition imposed by the Court below. Page No.2/4
