Petition filed under Article 226 of the Constitution of India to issue a Writ of Mandamus directing the respondents to dispose the petitioner representation dated 06.07.2016 and to issue separate Patta in the name of petitioner from joint Patta No.700 to the petitioner property an extent of 0.44.0 Ares (1.09 acre) wet land comprised in Survey No.64/5, Kalathur Village, Ulundurpettai Taluk, within the Thirunavallur Sub Registration District. By consent, the writ petition is taken up for final disposal.
2.The petitioner claims to be the absolute owner of the landed property admeasuring to an extent of 0.44.0 Ares (1.09 acre) comprised in Survey No.64/5, Kalathur Village, Ulundurpettai Taluk, Villupuram District and they are purchased through a registered sale deed bearing document no.506/2015 dated 16.04.2015 and one of the co-owners namely, K.Pandian claims to be in possession and enjoyment of the same. The petitioner would further state that in respect of the said land, a joint patta bearing no.700 was issued by the Tahsildar, Ulundurpettai in the names of Ganesan, Pandian and Sankar. The petitioner submitted a representation dated 06.07.
2016 to the respondent praying for transfer of patta by enclosing necessary documents and intends for making the prescribed fee and despite receipt and acknowledgement of the online application, no orders have been passed and hence, came forward to file this writ petition. 3.Heard the submissions of Mr.G.Ranganathan, learned counsel appearing for the petitioner and Mr.Era Premnath, learned Government Advocate who accepts notice on behalf of the respondent.
4.Though the petitioner prayed for a larger relief, this Court in
the light of the above facts and circumstances and without going into the merits of the same, directs the respondent to consider and dispose of the petitioner's online application/ representation dated 06.07.2016, in accordance with law, after putting on notice, one of the joint pattadhars namely, Pandian (patta no.700) and pass orders, within a period of eight weeks from the date of receipt of a copy of this order and communicate the decision taken, to the petitioner as well as to the concerned person.
