PRAYER: Writ Petition filed under Article 226 of the Constitution of India, to issue a Writ of Mandamus or order or direction in the nature of a writ, directing the 1st respondent to dispose the appeal dated 21.09.2020 filed by the petitioner against the final order in charge memo in No.232-6628-D5TNSTC, (Salem)-2018 dated 29.02.2020 (served on 05.08.2020). ORDER
This Writ Petition has been filed to direct the 1st respondent to dispose the appeal, dated 21.09.2020 filed by the petitioner against the final order in charge memo in No.232-6628-D5-TNSTC, (Salem)-2018, dated 29.02.2020.
2.It is the contention of the petitioner that the petitioner was working as Conduction in the 4th respondent Corporation and he is a Member of the Labour Welfare Protection Trade Union. A charge memo has been issued to the petitioner on 12.04.2018 for shortage of Rs.45/- at the time inspection in the bus. After completion of enquiry, the 2nd respondent passed an exparte final order in the said charge memo on 29.02.2020 by imposing penalty of stoppage of increment of salary for three years. Aggrieved against the same, the petitioner has preferred an appeal before the 1st respondent on 21.09.2020, however the same has been pending for the Page No.2 of 5
past three years and no orders have been passed. Hence, seeks direction of this Court.
3.Mr.K.Raja, learned counsel accepts notice on behalf of the respondents and submitted that the appeal preferred by the petitioner will be disposed as soon as possible.
4.Considering the limited relief sought for in this Writ Petition, there shall be a direction to the 1st respondent to dispose of the appeal preferred by the petitioner, within a month from the date of receipt of a copy of this order.
5.With the above direction, this Writ Petition is disposed of. No costs.
