2. The learned counsel for the second respondent has got serious objection in allowing this petition.

3. The petitioner would aver that due to his ill-health, he is not in a position to meet out litigative expenses, which has resulted in a delay of 467 days in preferring this Civil Miscellaneous Appeal.

4. Accepting the averments made in the affidavit filed in support of this petition, this petition is allowed subject to the condition that the interest for the delay period of 467 days shall stand waived.
