The petitioner, who apprehends arrest at the hands of the respondent police for the alleged offences punishable under Sections 8(c) r/w 20(b)(ii)(B) of NDPS Act, 1985, in Crime No.213 of 2022, seeks anticipatory bail.

2. The case of the prosecution is that the petitioner along with other accused were found in illegal possession of 1100 grams of Ganja. Hence, the complaint.

3. The learned counsel appearing for the petitioner would submit that the petitioner is an innocent person and he was no way connected with the alleged offence. Therefore, he prays for grant of anticipatory bail to the petitioner.

4. The learned Government Advocate (Crl.Side) appearing for the respondent would submit that the there are totally 2 accused in this case in which, the petitioner is arrayed as A2. The petitioner along with

other accused were in conscious possession of 1100 grams of Ganja and the petitioner is having one previous case against him. He would further submit that the earlier anticipatory bail petitions filed by the petitioner were dismissed. Hence, he vehemently opposed to grant anticipatory bail to the petitioner.

5. Considering the facts and circumstances of the case and now there is no change in circumstances of this case, Therefore, this Court is not inclined to grant anticipatory bail to the petitioner.

6. Accordingly, this Criminal Original Petition is dismissed. 23.09.2022 kv
