The petitioner, who apprehends arrest at the hands of the respondent police for the offences punishable under Sections 420, 406 of IPC r/w Section 120B of IPC and Section 5 of TNPID Act in Crime No.7 of 2019, seeks anticipatory bail.

The case of the prosecution is that, on 12.01.2019, the de-facto complainant/Chitra gave a complaint against the Kuzhanthaivel, Jailani, Senthil, Anajalaidevi and others alleging that they were running financial companies Viz., Sudar Self Help Society, Sudar Oli Benefit Fund Nithi Ltd, Sudar Oli Marketing Solutions Limited and Deepam Multi State Cooperative Society Ltd and cheated the de-facto complainant to the tune of Rs.90,200/-. Hence, the complaint.
3. The learned counsel for the petitioner stated that A1 was arrested and remanded to judicial custody and subsequently, he was granted bail in Crl.O.P.No.890 of 2020 on 24.01.2020 and the
bail condition was also subsequently relaxed. Hence, he prays for grant of anticipatory bail to the petitioner.
4. The learned Government Advocate (Crl.side) filed the objections statement of the investigation officer.
5. From the objection statement, I find that there are as many as 375 depositors said to have deposited to an extent of Rs.51,17,780/- in the said companies. As far as the petitioner is concerned, Rs.90,200/- is said to have been collected by her on behalf of the unauthorised chit company run by the A1. The accused company and its respective Directors, A5/Kuzhandaivel, A6/Janani, A7/Senthil, A8/Anajalidevi and shareholders Ashokumar/A9, Selvi/A10, Paramasivam (late)/A11, Soukathali /A12, Kausalya/A13 (petitioner herein), Soundarajan/A14, Rajaraman/A15 has collected deposits to the tune of Rs.51,17,780/- from various walks of life, in which, so far 375 complaints have been received.
6. Considering the overt act alleged against the petitioner and the active role played by the petitioner herein in running
Deepam Multi State Cooperative Society Ltd, I am not inclined to grant the relief of anticipatory bail to the petitioner for the present with a liberty to file a fresh petition after passage of some time.
7. Accordingly, this Criminal Original Petition is dismissed.
