ORDER
The petitioner has filed this revision to set aside the order passed by the learned Judicial Magistrate No.II, Dharmapuri, in Crl.M.P.No.213 of 2025, dated 09.06.2025.
2. Heard, Mr.M.R.Elavarasan, the learned counsel for the petitioner and Dr.C.E.Pratap, learned Government Advocate (Crl.Side), appearing for the respondent and perused the materials available in record.
3. Challenging the dismissal order passed in the Discharge Application in Crl.MP No. 213 of 2025, the learned counsel for the petitioner submits that there is no specific overt act attributed to him with regard to the alleged offences under Sections 294(b), 323, 324, and 506(i) of IPC. He further submits
that, according to the prosecution, the petitioner was charged under Sections 294(b) and 323 of IPC; however, no deadly weapon was used, and this is a matter to be examined during trial. As rightly pointed out by the prosecution, there is also a counter case in STC.No. 1024 of 2024 pending before the learned Judicial Magistrate-II, Dharmapuri. Therefore, the petitioner has to work out his remedy before the trial Court.
4. The other connected case is now ripe for trial and stands separated. Hence, the trial Court is directed to dispose of the case within a period of six months from the date of receipt of a copy of this order. Since the petitioner is a student, his personal appearance is dispensed with. 5.In view of the above, this Criminal Revision case is disposed of. 04-09-2025 rri Index:Yes/No
