ORDER : The Court Made the following order :- (The case has been heard through video conference) The petitioner who was arrested and remanded to judicial custody on 03.11.2021 for the offences under Sections 328 of IPC and Section 7 and Section 24(1) of Cigarette and Other Tobacco Products Act, in Crime No.887 of 2021, on the file of the respondent police, seeks bail.

2. The case of the prosecution is that based on a secret information, when the respondent police conducted a search at the place of the accused and found 1121 kgs. of banned tobacco products. Hence, the complaint.

3.The learned counsel for the petitioner would submit that the petitioner is no way connected with the alleged offence. The petitioner was entrusted to deliver some goods by A1 from his godown to Super market and without knowing, the petitioner, delivered the same and now the petitioner has been made as a scapegoat in this https://hcservices.ecourts.gov.in/hcservices/

case. He would further submit that the petitioner has been suffering incarceration for about 20 days from 03.11.2021 and hence, he would pray for grant of bail to the petitioner.

4.The learned Government Advocate (Crl. Side) would raise strong objection stating that the proposal for Goondas is under process. 5.On seeing the grave nature of offence and the quantity of the alleged tobacco products is very huge and that the investigation has not been completed and therefore, this Court is not inclined to grant bail to the petitioner. Accordingly, this Criminal Original Petition is dismissed.
