PRAYER: This Criminal Original Petition has been filed under Section 482 Cr.P.C. to issue direction to the 2nd respondent to register the petitioner's complaint dated 24.09.2021 and investigate the matter and file the final report within the stipulated time.

ORDER
This criminal original petition has been filed to issue direction to the 2nd respondent to register the petitioner's complaint, dated 24.09.2021 and investigate the matter and file a final report within the stipulated time. 2.The grievance of the petitioner is that the petitioner lodged a complaint on 24.09.2021, but the second respondent has not registered the complaint. Following the same, the petitioner sent a representation to the Superintendent of Police on 04.10.2021. Even then, no action has been taken against Jaganathan and failed to arrest him. The said Jaganathan is a History sheeter, rowdy element, who was detained under Goondas and he threatened and abused the petitioner with dire consequences, when the petitioner demanded the sale consideration of Rs.41,65,000/-, which was given earlier or else to execute the sale deed. https://hcservices.ecourts.gov.in/hcservices/
3. The learned Additional Public Prosecutor submits that pursuant to the complaint, the petitioner was called for enquiry and he appeared on 25.09.2021 & 30.09.2021 and the counter complainant Jaganathan appeared and submitted that the petitioner is a defendant in O.S.No.107 of 2021, which is pending before the Munsif Court, Polur and in the civil suit, for the said property, injunction has been sought, for peaceful enjoyment. Since civil suit is pending between the petitioner and the counter complainant, the respondent police directed both the parties to seek their remedy before the civil Court.
4.Recording the abovesaid submissions, the criminal original petition is disposed of with the direction to the respondent police to take necessary action, if any cognizable offence is made out.
