ORDER
This writ petition has been filed to declare that the action of the 2nd respondent in reopening the sealed cover of the will on 11.8.2021 by overlapping the notice vide Na. Ka. No. 2500 / A1 / 2021 dated 9.8.2021 is null and void and the same is against to the provisions of the section 45 of Registration Act 1908.
2. On perusal of records, it appears that this matter is pending since the year 2022. Even today, there was no representation on behalf of the petitioner.
3. Further, it was submitted by the respondents that the prayer sought for by the petitioner has to be entertained by an appropriate Civil Court and the present petition cannot be entertained by this Court.
4. In view of the above, it appears that the petitioner has no interest to prosecute the present case. In such case, this Court is not inclined to keep this matter pending.
5. Accordingly, this petition is dismissed for non-prosecution. No costs.
