ORDER

This Petition has been filed for direction to return the RC book pertaining to the tipper lorry bearing Registration No.TN 61-8728.

2. The petitioner's lorry was seized in pursuant to registration of FIR in Crime No.346 of 322 registered for the offences under S ection 379 of I.P.C and Section 21(1) MMDR Act alleging that the petitioner's lorry was seized for transportation of five units of river sand by its driver. In pursuant to the registration of FIR, the vehicle was seized and produced before the trial court. While returning the lorry, this Court imposed the condition that the petitioner shall surrender his original RC book. Accordingly, the petitioner surrendered his RC book and produced the lorry. Now the petitioner wants to extend the permit and also to obtain evidence certificate for the lorry for which the Registration Certificate must be produced before the authority concerned.

3. In view of the above, the trial court is directed to return the certificate of registration to the petitioner. On receipt of the Registration Certificate the

petitioner shall surrender the RC book once again before the trial court, within a period of one month from the date of receipt of the RC book from the court, failing which the respondent is at liberty to seize the lorry and produce it before the trial court in Crime No.346 of 2022. The District and Sessions court, Mayiladuthurai is directed to give interim custody of the RC book to the petitioner for a period of one month.
