Writ of Mandamus has been instituted to direct the respondents to consider the petitioner's representation dated 02.07.2020 and to take appropriate action against the 8th respondent school for encroaching the vacant land admeasuring total area of 2.5 acres in Survey No.348/F2 as 2/5

play ground at Kaniyur Village, Madathukkulam Taluk, Tiruppur in accordance with law by virtue of G.O.Ms.No.540 of 2014 dated 04.12.2014 within stipulated time as fixed by its court.

2. Learned Additional Government Pleader relying on the counter affidavit filed by the Assistant Director, Geology and Mining, Tiruppur, would submit that action was taken for illegal mining activities and by following the procedures, fine was imposed on the perpetrator.

3. Learned counsel for the petitioner would submit that the order, imposing fine was set aside by the Appellate Authority.

4. However, the said order was not challenged in the present writ petition. That being so, the relief sought for in the present writ petition lost its relevance. Consequently, the Writ Petition stands closed. However, the petitioner is at liberty to take appropriate action, if required. No costs. (S.M.S.,J.)
