ORDER

The petitioner herein alleged to have set fire to 17 two wheelers totally worth about Rs.5 lakhs, when he sought for bail, the trial Court imposed condition to deposit a sum of Rs.1,00,000/- in Crime No.170 of 2023 and to execute a bond for sum of Rs.10,000/- along with two sureties for like sum and one of the sureties must be a blood relative or family members of the petitioner/accused, which according to the petitioner is onerous. Even assuming that for damage of five lakhs, condition to deposit a sum of Rs.1,00,000/- is onerous, the petitioner has to pay some security since the offence involving damages to the public property worth more than five lakhs.

2. Learned counsel for the petitioner submits that the petitioner can afford Rs.50,000/- cash surety.

3. Considering the submissions and fact that the petitioner who was arrested in the month of April 2023, is in prison for more than 120 days, the bail condition imposed by the trial Court regarding furnishing security of Rs.1,00,000/- is modified to Rs.50,000/-. The said amount shall be paid to the credit of the Crime No.170 of 2023 and comply the 2/4

other bail conditions imposed by the trial Court vide order dated 08.05.2023. On compliance of the above condition, the petitioner shall be granted bail.
