ORDER

The present criminal original petition has been filed seeking a direction to the learned Fast Track Court No.II, Metropolitan Magistrate, Egmore, Chennai-8, to expedite the trial of the case in C.C.No.6846 of 2016 and complete the trial within three months time.

2. It is the case of the petitioner that originally, he filed a private complaint before the learned V Metropolitan Magistrate, Egmore, Chennai, on 8.11.2012 as against the respondents herein on the allegation of dishonour of cheque and the same was taken on file as C.C.No.5533 of 2012. Subsequently, in view of the decision of the Hon'ble Supreme Court, the case was transferred to Madurai and after that, the said case was transferred to the Fast Track Court No.I, Egmore, Chennai on 31.12.2015 and renumbered as C.C.No.6846 of 2016. Again, the said case was transferred to Fast Track Court No.II, Egmore, Chennai. Thus, though the case is of the year 2012, till date, the trial has not yet commenced. Hence, he has come forward with the present petition seeking a direction to the Fast Track Court No.II, Metropolitan Magistrate, Egmore, Chennai-8, to expedite the trial of the case in C.C.No.6846 of 2016 and complete the same within three months time. https://hcservices.ecourts.gov.in/hcservices/

3. The subject matter is relating to dishonour of cheque attracting Section 138 of the Negotiable Instruments Act. Since the case is of the year 2012, the petitioner seeks early disposal of the case.

4. Considering the facts and circumstances of the case, the Fast Track Court No.II, Metropolitan Magistrate, Egmore, Chennai is directed to take up the case in C.C.No.6846 of 2016 and dispose of the same as expeditiously as possible. The present criminal original petition is disposed of accordingly.
