This is an application to record the death of the first plaintiff namely, K.Rajeshwari and recognize the plaintiffs 2 to 5 and defendants 7 to 10 as the legal representatives of the deceased plaintiff K.Rajeshwari. 2.The learned counsel for the defendants D7 to D10 submitted that they have no objection to allow this application, but submitted that D7 is the wife of predeceased K.Shanmuga Sundaram and therefore she is not the legal heir of the deceased first plaintiff.

3.The learned counsel for the petitioners submitted that the plaintiffs 2 to 5 and D8 to D10 may be recognized as legal heirs of deceased first plaintiff. 4.Considering the reasons stated in the affidavit, submissions of learned counsel appearing for the parties, this Court allows this application in part and recognizes the plaintiffs 2 to 5 and defendants 8 to 10 as legal heirs of the deceased plaintiff.

5.The learned counsel for the plaintiff is directed to take appropriate steps for amending the plaint and file amended plaint in two weeks time. 6.Post the matter after two weeks.
