Criminal Original Petition filed under Section 482 of the Code of Criminal Procedure, to direct the respondents to register the complaint based on the petition dated 18.09.2021 lodged by the petitioner and proceed according to the law. ORDER
This petition has been filed to direct the respondents to register the complaint based on the complaint lodged by the petitioner on 18.09.2021 and to proceed according to the law.
2. Heard the learned counsel for the petitioner and the learned Additional Public Prosecutor appearing on behalf of the respondents.
3. The grievance of the petitioner is that the petitioner had lodged a complaint on 18.09.2021 in C.S.R. No.541 of 2021 and no action has been taken against his complaint. 4.The Learned Additional Public Prosecutor stated on the complaint filed in C.S.R.No.541 of 2021, the respondent police investigated the matter and found that there is a dispute with the petitioner and one Gnana Samuel, Gnana Paul and Kalaichelvi. On enquiry, it was found that the dispute between the parties are civil in nature and civil suit is also pending between them. In view of the above, the C.S.R.No.541 of 2021 came to be closed and the petitioner was advised to approach the Civil forum. It is further admitted by the respondent police that the closure report has not been submitted. 5.
In view of the above, the respondent police is hereby directed to serve a closure report to the petitioner. The petitioner is also stated that the power connection to his property has been disconnected by the counter complainants. The respondent police cannot take any action against the disconnection of the power. The petitioner is directed to approach the TNEB authorities to restore the power supply and to take appropriate action in this regard.
6. With the above direction, this Criminal Original Petition is disposed of .
