ORDER

This petition has been filed to quash the FIR in Crime No.22 of 2023 pending before the 1st respondent. 2.

Based on the complaint given by the 2nd respondent, an FIR has been registered in Crime No.22 of 2023 dated 23.07.2023 for offence under Sections 417, 294(b), 498(A), 506(1) and Section 4 of Dowry Prohibition Act, 1961.

Heard Mr.A. Arasu Ganeshan, learned counsel for the petitioner and Mr. A. Damodaran, learned Additional Public Prosecutor for 1st respondent.

On carefully going through the allegations made in the FIR, it is seen that the entire allegations are focused against A1 to A4. The 1st petitioner (A5) happens to be the relative of A3 and the 2nd and 3rd petitioners (A6 and A7) happen to be the daughters of A5. An omnibus allegation has been made and thereby, these petitioners have also been roped in as an accused in this case.

In the considered view of this Court, the petitioners need not be treated as accused in this case for the present and therefore, statements shall be recorded under Section 161 (3) of Cr.PC. On completion of investigation, the respondent police shall file a final report only as against those persons against whom materials are available.

This Criminal original petition is disposed of accordingly. Consequently, the connected miscellaneous petition is closed.
