The application has been filed seeking to condone the delay of 467 days in filing the written statement by the 2nd and 3rd defendants.

2. In the affidavit filed to explain the delay, it had been stated that an application had to be filed to set aside the exparte order and thereafter, there was also a police complaint which had been given and in view of all those reasons, instructions could not be given to the counsel to prepare the written statement, there has been a delay.

3. In view of the fact, that it would only be appropriate that the parties are permitted to set out their pleadings in any Civil Suit, I would condone the delay and take on record the written statements filed by the 2nd and 3rd defendants.

4. The application stands allowed.
