ORDER

This Criminal Revision Case has been preferred against the order dated 03.07.2025 passed in Crl.M.P.No.546 of 2025 by the learned District Munsif cum Judicial Magistrate, Thirukazhukundram, Chengalpattu District, thereby dismissing the petition for return of property.

2. Heard the learned counsel appearing on either side and perused the materials available on record.

3. The petitioner owned a two wheeler bearing Regn.No.TN-19BU-7725. The said vehicle was used for the illegal transportation of liquor, McLENE totalling 27 bottles. The two wheeler along with the liquor was seized and produced before the District Munsif cum Judicial Magistrate, Thirukazhukundram, Chengalpattu District, pursuant to the registration of the FIR in Crime No.226 of 2025 for the offences punishable u/s 4(1)(a) of Tamil Nadu Prohibition (Amendment) Act, 2024 and Section 4(1)(i) of Tamil Nadu Prohibition Act. Therefore, the petitioner filed an application seeking return of the vehicle, which was dismissed by the Trial Court vide impugned order dated 03.07.2025.

Learned Government Advocate (Crl.Side) appearing for the respondent submitted that the petitioner's vehicle was involved in the commission of offences under the TNP Act in more than seventeen (17) cases apart from the present case. Further, he submitted that the respondent has initiated the confiscation proceedings against the said vehicle, which is pending.

5. In view of the above, this Court finds no infirmity or illegality in the order dated 03.07.2025 passed in Crl.M.P.No.546 of 2025 by the learned District Munsif cum Judicial Magistrate, Thirukazhukundram, Chengalpattu District. Accordingly, this Criminal Revision Case stands dismissed.
