Respondent Writ Petition filed under Article 226 of the Constitution of India, seeking for a Writ of Mandamus directing the respondent to consider the petitioner's request dated 29.08.2016 and permit him to adorn the Hindu God Vinayagar, 4 feet mud Idol for nine days at MSM Thootam Streets in nine places from 05.09.2016 to 13.09.2016 by observing all conditions of the respondent and take the idol to the holy river kaveri on 13.09.2016 for immerse as per the Hindu Custom.

The petitioner is claims to be a member of M.S.M Youth and M.S.M Resident Welfare Association, Uthangarai - 635 207. They submitted an application dated 29.08.2016 to conduct a "Vinayagar Chathurthi" festival by installing the statue of Lord Vinayaga in connection with said festival between 05.09.2016 and 13.09.2016. Since no orders have been passed, came forward to file this writ petition.

2. Learned counsel appearing for the petitioner would submit that for time immemorial, the petitioner association is permitted to conduct Vinayagar Chathurthi festival and for this year also, necessary permission may be granted and prays for appropriate orders.

3. Per contra, Mr.R.Govindasamy, learned Special Government Pleader appearing for the respondent, would contend that permission will be given only for three days, namely from 05.09.2016 to 07.09.2016.

4. In the light of the above said submission, the writ petition is disposed of and the respondent is directed to accord permission to the petitioner association to conduct "Vinayagar Chathurthi" festival from 05.09.2016 to 07.09.2016 strictly in accordance with law. The respondent shall be at liberty to impose necessary conditions for orderly conduct of the said festival. No costs.
