ORDER

This Writ Petition has been filed for a direction to the respondent Police to give Police protection in order to enable the celebration of Aadi Ammavasai on 16.08.2023 at Arulmugu Palaya Mariamman temple at Thirumalaipatti village, Namakkal district.

2. The learned Additional Public Prosecutor, on instructions, submitted that there is a dispute between two parties in celebrating the festival and hence complaints were given from both sides and based on the complaint, the matter has now been referred to the R.D.O under Section 107 of Cr.P.C.

3. The learned Counsel for the petitioner submitted that the festival will be conducted peacefully and that the temple is situated near the Highways and since a large crowd will come for the festival, some regulation is required from the Police.

4. In the considered view of this Court, if there is a crowd and it causes disturbance for the movement of vehicles in Highway, the Police knows how to deal with such a situation and there is no need for this Court to give any specific directions in that regard. However, it is made abundantly clear that in the name of temple festival if any violence is perpetrated, it is left open to the Police to take immediate action against the concerned persons and if required, to stop the further festival from being conducted.
