PRAYER : Petition filed under Article 226 of the Constitution of India praying for issuance of Writ of Mandamus directing the first respondent to dispose of the Application/Representation dated 26.11.2024 seeking to correct the patta 233 and 52 issued by the Deputy Tahsildar Tiruvanamalai District with a time frame stipulated by this Honourable Court. By consent of learned counsel on both sides, this writ petition is taken up for final disposal at the admission stage itself. In view of the order that this Court proposes to pass and also the limited relief that is sought to be granted, notice to respondent No.5 is dispensed with.
2. The present writ petition is filed praying for a writ of mandamus to direct the 1st respondent to dispose of petitioner's application/representation dated 26.11.2024 seeking to correct the patta 233 and 52 issued by the Deputy Tahsildar, Tiruvanamalai District within a time
frame stipulated by this Court.

It is submitted by the learned counsel for the petitioner that the petitioner is the absolute owner of the property at S.Nos.32/4, 32/8 and 32/9 situated at Sananandhal Village, Thiruvannamalai District as per the Partition deed and Exchange deed dated 28.06.1979 and 28.01.1984 respectively. Since patta does not reflect the accurate land divisions as per the title, petitioner has given representation to the first respondent seeking rectification and re-issuance of patta. However, the said representation has not been considered so far. Aggrieved by the same, the petitioner has come before this Court.

Learned Additional Government Pleader for respondents 1 to 4 would submit that the District Collector is not the competent authority to look into the representation given by the petitioner seeking grant/modification of patta. If the petitioner so desires, he may file an appropriate application before the Tahsildar or if he is aggrieved by the issuance of patta, he may file an appeal before the District Revenue Officer.

In view of the same, taking into consideration the facts and circumstances of the case and the limited relief sought for in this Writ Petition, the petitioner is permitted to file an application before the Tahsildar or an appeal before the District Revenue Officer seeking grant of patta (or) rectification of patta. If such an application/appeal is filed, the concerned respondent shall consider the same, after issuing notice to the petitioner, 5th respondent and any other interested parties including the rival claimants, if any and after affording reasonable opportunity of hearing to the petitioner and any other interested parties, within a period of eight weeks from the date of uploading of web copy without waiting for the receipt of certified copy. It is made clear that, this Court has not expressed any views with regard to the merits of the representation and it is open to the respondent concerned to consider the representation on its own merits and in accordance with law. No costs.
6. Accordingly, the writ petition stands disposed of. There shall be no order as to costs.
