This Criminal Original Petition has been filed seeking to enlarge the petitioner on bail in the event of her arrest in Crime No.239 of 2022 on the file of the respondent Police.
2. The case of the prosecution is that the petitioner along with the other accused waylaid the de-facto complainant and abused her in a filthy language and assaulted her with hands, causing injuries. Hence the complaint.
3. The learned counsel appearing for the petitioner would submit that the petitioner is an innocent person and this is the false case that has been foisted as against the petitioner. Hence, he prays for grant of bail to the petitioner.
4. Per contra, the learned Government Advocate (Crl.Side) would submit that the petitioner and the other accused had waylaid the
de-facto complainant and abused her in a filthy language and caused injuries by assaulting her with hands. He would also submit that there are 4 previous cases against her. Hence, he vehemently opposed to grant bail to the petitioner.
5. Heard the learned counsel for the petitioner and the learned Government Advocate (Crl.Side) for the respondent and perused the materials available on record.
6. Taking into consideration the facts and circumstances of the case and the submissions made by the learned Government Advocate (Crl.Side) and also taking note of the fact that the petitioner having 4 previous cases, this Court is not inclined to grant bail to the petitioner.
7. Accordingly, this Criminal Original Petition stands dismissed for the present.
