Respondents PRAYER : Writ Petition has been filed under Article 226 of the Constitution of India to issue a Writ of Mandamus, directing the respondents to consider and pass orders within a time frame, on the petitioner's representation dated 12.10.2015 for appointment on compassionate grounds, in a suitable post, commensurate with the petitioner's education qualification, consequent on the death of her husband Thiru S.Perumgnanavel, on 29.01.2014 serving as a Tank Operator in Mannadipattu Commune Panchayat, Thirubhuvanai.

O R D E R

This Writ Petition has been filed to direct respondents to consider the representation of the petitioner for appointment of the petitioner on compassionate grounds within a time frame to be fixed by this Court.

2. The husband of the petitioner, one Perumgnanavel was serving as Tank Operator in the second respondent Panchayat and her husband expired on 29.01.2014. Thereafter, the petitioner gave representation to the respondents for providing appointment to the petitioner on compassionate ground. But till date, the representation of the petitioner has not been considered and hence, the Writ Petition has been filed.

3. The learned counsel for the petitioner would submit that even though the petitioner has submitted the representation in the year 2015, the respondents have not considered the same for appointing the petitioner on compassionate grounds and he would be satisfied if this Court directs the respondents to consider the representation of the petitioner and pass appropriate orders as expeditiously as possible.

4. The learned Government Pleader appearing for the respondents has got no serious objection for directing the respondents to consider the representation of the petitioner and pass appropriate orders in accordance with law.

5. Considering the submissions made on either side, this Court, without going into the merits of the claim made by the petitioner, directs the respondents, to consider the representation of the petitioner dated 12.10.2015 and pass appropriate orders, on merits and in accordance with law, as expeditiously as possible. It is made clear that this Court has not expressed any opinion with regard to the merits of the claim made by the petitioner.
