ORDER

The petitioner, who was arrested and remanded to judicial custody on 03.03.2025, for the alleged offence punishable under Sections 8(c) r/w 20(b)(ii)(C) of NDPS Act in Crime No.104 of 2025, on the file of the respondent police, seeks bail.

2. The allegations against the petitioner is that on 03.03.2025 at about 17.00 hours, the respondent police, acting on information about the transportation of ganja, intercepted the petitioner. The petitioner was found in possession of 20.300 kgs of ganja. After completing the mandatory procedures, the contraband was seized and the petitioner was arrested. Hence, the case.

3. Learned counsel appearing for the petitioner submitted that the petitioner is an innocent person and he has been falsely implicated in this case. He would further submit that the petitioner was arrested and he is in judicial custody from 03.03.2025 and is ready to abide by any conditions that may be imposed by this Court. Hence, he prayed for grant of bail to the petitioner.

Learned Government Advocate (Crl.Side) appearing for the respondent police submitted that the petitioner herein was found in possession of 20.300 kgs of Ganja, which is considered a commercial quantity. Consequently, the provisions of Section 37 of the NDPS Act are apply to the petitioner, and he opposed for grant of bail to the petitioner.

5. Heard both sides and perused the materials available on record including the First Information Report.

6. Considering the submissions of the learned counsel on either side, the petitioner was found in possession of 20.300 kgs of ganja, which is the commercial quantity. There is no material evidence that the weight was increased by mixing other contraband, and therefore the rigours of Section 37 of the NDPS Act are applicable to the petitioner, and this Court is not inclined to grant bail to the petitioner.
