ORDER

This Writ Petition has been filed seeking a direction to the respondents to disburse the statutory entitlement namely 30% solatium with interest till the date of payment, in the light of judgement of Hon'ble Supreme Court of India in the matter of Union of India and another Vs Tarsem Singh and others, in civil Appeal No.7064 of 2019, Dated 19.9.2019 by considering Petitioner's representation dated 06.01.2023 within time framed manner.

2. The learned counsel for the petitioners would submit that the petitioner's land was acquired for formation and widening four/six laning of roads on NH No.68 at Salem District, under the National Highways Act, 1956, for which the compensation was paid to the petitioner but solatium was not paid to him.

2.1.Further he would submit that the petitioner is entitled for solatium as per the Judgment of Hon'ble Apex Court in the case of Union of India and Another Vs Trasem Singh and others (Civil Appeal No. 7064 of 2019 dated 19/9/2019). Hence, the petitioner made a representation to the respondents on 06.01.2023, seeking to disburse the statutory entitlement viz., namely 30% solatium with interest till the date of payment. As the same did not evoke any response, the petitioner has come forward with this writ petition seeking for the

aforesaid relief.

3. In reply, the learned Additional Government Pleader appearing for the respondent would submit that the petitioner's representation dated 06.01.2023 will be disposed of by the 1st respondent within a period of twelve weeks.

4. Heard both sides. Perused the materials available on record.

5. Considering the facts and circumstances of the case and having regard to the submissions made, this Court directs the 1st respondent to consider the petitioner's representation dated 06.01.2023 on its own merits and dispose of the same in accordance with law, in the light of Judgment of Hon'ble Supreme Court in Union of India and Another Vs Trasem Singh and others (Civil Appeal No. 7064 of 2019 dated 19/9/2019) within a period of twelve weeks from the date of receipt of copy of this order, .
