Prayer: Petition filed under Article 226 of The Constitution of India praying for the issuance of a Writ of Mandamus directing the fourth respondent - the Block Development Officer, Tiruchengode to ensure that the seventh respondent - the President, 'Om Muruga Vivasaigal Neeretru Pasana Sangam' lays pipeline for irrigation in terms the permission granted in the order dated 09.8.2021 having reference to Na.Ka.No.132/2021/A2 on the file of the fourth respondent - the Block Development Officer, Tiruchengode.

ORDER

(Order of the Court was made by the Hon'ble Acting Chief Justice) Mrs.R.Anitha, learned Special Government Pleader, accepts notice for respondents 1 to 6.

2. The writ petition has been filed alleging violation of the terms of permission granted by the fourth respondent vide order dated 09.8.2021 to the seventh respondent for irrigation.

3. Photographs have been enclosed to indicate violation of the terms of permission.

4. The learned Special Government Pleader appearing for respondents 1 to 6 submits that the Authorities would ensure compliance of the terms of permission granted to the seventh respondent for irrigation and submit a report.

5. In view of the above, we dispose of the writ petition with a direction to respondents 1 to 6 - Authorities to ensure the compliance of the terms of permission granted by order dated 09.8.2021. The irrigation shall be carried out by the seventh respondent on those terms and they shall submit a report thereupon within two weeks from the date of disposal of this case. Consequently, the connected WMP is closed. There will be no order as to costs.
