O R D E R

This writ petition has been filed for the issue of writ of Mandamus directing the respondents 1 and 2 to disburse the terminal benefits of the son of the petitioner based on the representation made by the petitioner on 01.12.2023.

Heard Mr.G.Muthu, learned counsel for petitioner and Mrs.P.T.Ramadevi, learned Standing Counsel for respondents 1 and 2 and Mr.S.Balamurugan, learned Government Advocate for 3rd respondent. 3.

The case of the petitioner is that her son A.Parasuraman was working in Chennai Corporation. He was married to one Manonmani in the year 2001. There were serious misgivings. As a result of which, they hardly lived together for a month. There were no issues out of the said wedlock. Ultimately, the marriage itself came to be dissolved by the Family Court by a decree of divorce dated 08.01.2020 made in OP No.3626 of 2019. 2/5

Unfortunately, the said Parasuraman died on 17.07.2023. The petitioner made her claim for the service benefits of her son. Since there was no response, the present writ petition has been filed before this Court seeking for appropriate directions.

Taking into consideration the facts and circumstances of the case and the limited relief sought for in this writ petition, there shall be a direction to the respondents 1 and 2 to consider the application submitted by the petitioner dated 01.12.2023 seeking for disbursement of the terminal benefits of the deceased Parasuraman, on its own merits and in accordance with law and a decision shall be taken within a period of eight weeks from the date of receipt of the copy of this order. 6.

The petitioner is directed to submit a fresh representation to the respondents 1 and 2 along with all the relevant documents and also a copy of this order.

This writ petition is disposed of with the above directions. No costs.
