COMMON PRAYER: Writ Petitions filed under Article 226 of the Constitution of India, praying to issue a Writ of Certiorarified Mandamus calling for the records on the file of the Respondents relating to the order passed by the 2nd respondent dated 14.02.2025 bearing Ref. No.16556/ IGMC and RI/A1 /Estt / 2024 / 533 quash the same and consequently, direct the respondents herein to extend the benefit of the decision taken by governing body of the 1st respondent in its 22nd Governing Body meeting held on 19.10.2022 and to re-engage and to regularize the petitioner in the post of multipurpose worker by considering the dedicated and selfless service rendered by the petitioner during testing times of Pandemic Covid -19 and the petitioners' long tenure in service, in the light of the recommendations issued by the Ministry of Health and family Welfare, Government of India dated 03.05.2021 bearing Ref.No.Z.20015/43/ 2021-MEI(FTS-8108321). 2/6

Additional Government Pleader (P) COMMON ORDER These writ petitions have been filed challenging the order of the 2nd respondent dated 14.02.2025 bearing Ref. No.16556 IGMC and RI/A1/Estt/ 2024 /533 quash the same and consequently, direct the respondents herein to extend the benefit of the decision taken by governing body of the 1st respondent in its 22nd Governing Body meeting held on 19.10.2022 and to re-engage and to regularize the petitioner in the post of multipurpose worker by considering the dedicated and selfless service rendered by the petitioner during testing times of Pandemic Covid-19 and the petitioners long tenure in service, in the light of the recommendations issued by the Ministry of Health and family Welfare, Government of India dated 03.05.2021 bearing Ref.no.Z.20015/43/2021-ME-I (FTS-8108321)
2. The issue that arises for consideration in all these writ petitions are one and the same, hence, a common order is passed.
3. The petitioners were engaged as Multipurpose Workers in the year 2016 3/6
on wards and have continuously rendered service in Indira Gandhi Medical College and Research Institute even during the COVID-19 Pandemic period. While so, the 2nd respondent vide memorandum dated 23.02.2021 disengaged the petitioners from service. Aggrieved by the same, the petitioners submitted a representation on 13.09.2024 seeking re-engagement and regularisation of their service in the light of the recommendations issued by the Ministry of Health and Family Welfare, Government of India dated 03.05.2021, however, the same was not considered by the respondents.

It is submitted by the learned counsel for the petitioners that pursuant thereto, the petitioners filed a writ petition before this Court in W.P.No.33678 of 2024, praying to consider the representation dated 13.09.2024. This Court vide order dated 14.11.2024 issued a direction to the respondents to consider the representation submitted by the petitioners and pass appropriate orders on merits and in accordance with law, however, the respondents have passed the impugned rejection order dated 14.02.2025. Challenging the same, the petitioners filed these writ petitions seeking appropriate relief. The learned counsel counsel for the petitioners would therefore pray this Court to grant liberty to the petitioners to approach the Government again on the basis of the Minutes of the 22nd Governing Body Meeting dated 19.10.2022 or before the Industrial Tribunal in the manner known to law.

5. Recording the same and without interfering with the orders impugned, these writ petitions are disposed of with liberty to the petitioners to work out their remedy in the manner known to law. No costs. Consequently, the connected miscellaneous petition is closed.
