ORDER

The matter is posted today under the caption "for Being Mentioned". It is brought to the notice of this Court that this petition was posted along with Crl.O.P.No.19157 of 2025 filed by the co-accused/A2 on 11.07.2025 and at that

day, this Court has granted the relief of bail only for A2 i.e., the petitioner in Crl.O.P.No.19157 of 2025. As the crime number in both the petitions are same and both the cases were listed on that day in a single item, due to inadvertent mistake, the order was made ready as if bail was granted in both the petitions i.e., in Crl.O.P.Nos.19603 & 19157 of 2025. Hence, the earlier order granting bail to the petitioner/A1 in Crl.O.P.No.19603 of 2025 dated 11.07.2025 is hereby re-called and this Court, passes the following order:

2. The petitioner, who was arrested and remanded to judicial custody on 03.06.2025, for the offences punishable under Sections 420 of IPC and Section 66D of Information Technology Act in connection with Crime No.49 of 2023, registered on the file of the respondent, seeks bail.

3. The case of the prosecution is that the petitioner along with others pretending themselves as the recruiter of job, alleged to have tantalized the defacto complainant through online under the guise of securing a part time job and cheated to a tune of Rs.27,64,666/-. Hence, the case.

4. The learned counsel for the petitioner would submit that the petitioner is innocent and he has been falsely implicated in this case. He further submitted that the petitioner is suffering incarceration from 03.06.2025, and he is ready to furnish sufficient sureties for his release on bail. Hence, he prayed for grant of bail to the petitioner.

5. Learned Government Advocate (Crl.Side) appearing for the respondent police reiterated the prosecution case and on instructions submitted that the case is under investigation, at this stage, if the petitioner is released on bail, there are every possibilities for tampering the witnesses and hampering the investigation, thereby, he strongly opposed to grant bail to the petitioner.

6. Heard both sides and perused the materials available on record.

7. Considering the facts and circumstances of the case, that huge amount is involved in this case and the serious overt-act leveled against the petitioner/A1, this Court is not inclined to grant bail to the petitioner.

8. Accordingly, this Criminal Original Petition stands dismissed. 16-07-2025 jai Note: Registry is directed to issue fresh order copy to the parties.
