The petitioner who apprehends arrest at the hands of the respondent police for the offences punishable under Sections 8(c), 20(b)(ii)(B), 25, 29(1) of NDPS Act 1985 in Crime No.399 of 2022, seeks anticipatory bail.

2. The case of the prosecution is that on 02.08.2022, the respondent police had found two persons standing in suspicious manner in their two wheelers bearing Registration Nos. TN 04 BA 2892 and TN 04 AX 3912 and on search, the petitioner and other accused were found to be in possession of 2.5 Kgs of Ganja. Hence, the case.

3. The learned counsel for the petitioner would submit that the petitioner is an innocent person and he has been falsely implicated in this case since he happens to be the friend of main accused. Therefore, he prays for grant of anticipatory bail to the petitioner. https://www.mhc.tn.gov.in/judis

4. Per contra, the learned Government Advocate (Crl.Side) appearing for the respondent would submit that the petitioner and other accused were found to be in possession of 2.5 Kgs of Ganja. He would further submit that the petitioner is a habitual offender and there are 19 previous cases pending against the petitioner out of which, 2 cases are similar in nature. Therefore, he vehemently opposed to grant anticipatory bail to the petitioner.

5. Taking into consideration the facts of the case and the submissions made by the learned counsel, and also taking note of the fact that there are 19 previous cases pending against the petitioner, this Court is not inclined to grant anticipatory bail to the petitioner.
